"The port marine safety code makes no new laws......"  or does it?
Recent cases have held that non-compliance shows lack of best-practice. This weakened defence means that Harbour Authorities (and now individual port facilities) would be foolish to consider it as anything other than Mandatory.

Our principal has been involved with the Port Marine Safety Code (PMSC) from the start, and his involvement on both the British Ports Association (BPA) Marine & Pilotage working group, and the UK Harbour Master's Association National Committee means he has had input into recent changes to both the Code (links above) and Guide to Good Practice (GTGP). One of the first to obtain a UKMA qualification (based on the National Occupational Standards (NOS), dictated by the code, he is also a trained and practising lead auditor. He has drawn up and been responsible for Code compliant Safety Management Systems (SMS).
A Maritime & Coastguard Agency (MCA / MCGA) Health Check described these as "the most mature and embedded system they had yet audited".
